1. Agreement

By creating an account, connecting a WordPress site with a connection key, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

SMTP Health Monitor provides optional cloud features for monitoring WordPress email health, including log storage, notifications, and scheduled checks, in conjunction with the separate SMTP Health Monitor WordPress plugin. The plugin can operate locally without the Service; cloud features require an account and a valid connection key.

3. Accounts and eligibility

You must provide accurate information when signing in (for example, a valid email address for magic-link authentication). You are responsible for activity under your account and for keeping connection keys and secrets confidential.

4. Acceptable use

You agree not to:

• Use the Service to violate applicable law or third-party rights.
• Attempt to gain unauthorized access to the Service, other users' data, or connected sites.
• Abuse the Service, including by overwhelming infrastructure with automated traffic unrelated to normal monitoring use.
• Use the Service to send spam or deceptive email through connected sites.

5. WordPress plugin

The WordPress plugin is distributed separately and may be subject to its own license (for example, GPLv2 or later). Your use of the plugin on your site is governed by that license; these Terms govern use of the hosted Service only.

6. Paid plans and billing

Some features may require a paid subscription processed by our payment provider (for example, Stripe). Fees, renewal, and cancellation are presented at checkout and in your billing portal. We may change plans and pricing with reasonable notice where required.

7. Availability and changes

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue parts of the Service with reasonable notice when practicable.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF NO FEES APPLIED, ONE HUNDRED U.S. DOLLARS (USD $100)).

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms or if we must do so to comply with law or protect the Service.

Our collection and use of personal data is described in the Privacy Policy.
